Stanford should adhere to the following policy.
Speech, writing and other forms are expression should be
punishable by Stanford only if they are legally punishable by
some level of Government acting in accordance with the First
Amendment to the Constitution of the U.S.
Any other policy is subject to abuse.
1. The First Amendment has a large body of case law giving
precedents for what is and isn't punishable. Any
other policy will have to develop its own ``case law''.
2. If another policy is adopted, judicial officers will
be subjected to political pressure to punish expression
offensive to one group or another.
3. ``Community standards'' will become matters of political pressure.
I fear CFAR will settle for too little.
